Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.441 of 2023 registered with Kopargaon Rural Police Station, DistrictAhmednagar for the offence punishable under Sections 302, 323, 504 read with Section 34 of the Indian Penal Code.

The allegations against the applicant are that the applicant pelted the stone on the head of the deceased. However, the cause of death is altogether different. It does not match with the role attributed to the applicant in the FIR. There are no antecedents to the discredit of the applicant. Considering these facts, the Court is of the view that his detention would not serve the purpose. Hence the following order:-

O R D E R

i) Bail Application stands allowed.

ii) The applicant - Raj @ Bablu Sunil Pol be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in the above crime, on the condition that:- (a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall attend the trial on each and every effective date.
