THE STATE OF MAHARASHTRA, THROUGH ITS SECRETARY, REVENUE AND FOREST DEPARTMENT, MANTRALAYA, MUMBAI ....
Ms P. C. Kale, Advocate h/f Mr Suvidh S. Kulkarni, Advocate for Petitioner;
Ms Neha Kamble, A.G.P. for Respondents/State CORAM : RAVINDRA V. GHUGE AND Y. G. KHOBRAGADE, JJ.
DATE : 10th July, 2024 PER COURT:
1.
We have perused the Writ order dated 16/01/2024, which is tendered across the bar, marked as 'X' for identification, as the same was not placed on record in this Petition. 2.
The learned A.G.P. points out on instructions that the Tahsildar, Jalna has informed the Sarpanch/Petitioner herein, vide the communication dated 21/06/2023, that, if police protection is sought while removing the encroachment, the same would be
606.24cp (2) provided.
The Petitioner candidly submits that the Grampanchayat has not deposited the requisite fees and has not asked for police protection.
3.
In such circumstances, we do not find that, there is any deliberate, intentional and willful disobedience on the part of any of the Respondents. This Contempt Petition is, therefore, disposed off.
4.
If the Petitioner deposits the requisite fees for seeking police protection, we trust that the Police Authorities concerned would do the needful without any delay.
