Admittedly, condition No. 8 was already relaxed by the order which is not flouted by the applicant. The applicant has come out before this Court seeking relaxation of condition No. 3 of the order dated 15/03/2012 passed by the Additional Sessions Judge, Parbhani in Criminal Application No. 104 of 2012. Mr. Choudhary, learned Counsel for the applicant would urge that the main accused Ramprasad has already granted relaxation by this Court by order dated 21/10/2013, who is now permitted to participated in the day today functioning and the political activities of the bank. According to Mr. Chaudhary, the applicant has already stood retired on 31/05/2013 and as such, by relaxing condition, presence of applicant
3635.15crapln -2will not be of having any adverse impact of working of the bank. 2.
It is required to be noted that condition No.8 which was relaxed by this Court was duly complied with till then by applicant and has not jumped or flouted. Apart from above, other accused is already granted relaxation by this Court on 21/10/2013 in Criminal Misc. Application No. 2369 of 2013. The applicant stood retired on 31/05/2013 from the service of the bank.

As charge sheet is filed, it will be appropriate to relax the Condition No. 9.

In view thereof, the application stands allowed in terms of prayer clause ( C ).
