The present writ petition is filed as the family pension sanctioned is cancelled on the ground that the post on which the husband of the petitioner was working become eligible for 100% grant in aid after 01.11.2005. The issue is no longer res integra in view of full bench judgment at principal seat of this Court dated 30.04.2019 in Writ Petition No. 8387 of 2013 with connected writ petitions.

Mr. Tripathi, the learned counsel submits that subsequently the Government Resolution has been issued by the State Government on 29.09.2018 wherein lumpsum payment of Rs. 10,00,000/- is to be made if an employee governed under DCPS and died within 10 years. The same would be a different claim. The petitioner may agitate the rights pursuant to the said Government Resolution by appropriate proceedings.

The writ petition is disposed of. No costs.
