:

MANISH PITALE AND Y. G. KHOBRAGADE, JJ.

DATE : 25.07.2025 PER COURT :

1.

Both these petitions have been filed by the Maharashtra State Road Transport Corporation (M.S.R.T.C.) raising grievances against respondent No. 2 - the Municipal Council, Nandurbar, with regard to the payments in respect of water charges as well as property taxes. 2.

In Writ Petition No. 9155 of 2025, the petitioner - M.S.R.T.C. claims that entire water charges have been paid and yet respondent No. 2 - the Municipal Council has not restored water supply. Jhs/ 1/2

Sr. No. 987 & 988 3.

Insofar as the Writ Petition No. 9156 of 2025 is concerned, it is submitted that the property taxes have been paid under protest and yet respondent No. 2 - the Municipal Council has not taken cognizance of the same.

4.

We fail to understand how the petitioner - M.S.R.T.C. can knock the door of the Writ Court invoking jurisdiction under Article 226 of the Constitution of India. If the petitioner has any grievance, it is at liberty to approach respondent No. 2 - the Municipal Council with regard to the same. If there are any grievances about the quantum of the water charges and the property taxes, a detailed regime of challenges and appeals before the competent authority, committee and magistrate is provided under the provisions of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965, which can be activated at the behest of the petitioner - M.S.R.T.C. in order to raise grievances. Nothing is made out warranting the exercise of writ jurisdiction. 5.

In view of the above, both Writ Petitions are dismissed. 6.

Pending applications, if any , also stand disposed of. (Y. G. KHOBRAGADE, J.) (MANISH PITALE, J.) Jhs/ 2/2
