The learned Advocate for the Petitioners submits on instructions that though the prayers do not mention anything about pension, all these Petitions can be disposed off in the light of the order
- 2 - of this Court in WP No.13028/2018 (Bhagwandas s/o Kishandas Vaishnav Vs. The State of Maharashtra and Others), passed at Aurangabad.

In all these cases, except Bhagwanrao Bapurao Deshmukh (WP No.14072/2019), all the other Petitioners have been appointed as Assistant Teachers prior to 1972 on the basis of their S.S.C. qualifications. The GR dated 04.10.1983, has granted a deeming effect to such teachers so as to be considered as deemed trained teachers. They are not entitled for actual monetary benefits, but the pensionary benefits.

In so far as Bhagwanrao Bapurao Deshmukh is concerned, paragraph of the GR dated 04.10.1983 dealing with primary school certificate holders (PSC), which means education upto 7th standard, the State Government has recorded as under :- जेअ्ቚशिቌኌत्ቚाथमि कशिक१९७२पूብኍ जिजल्हापरिषद/ नगपालि!का/ नगपरिषदा / नगपालि!काशिण ंडळ/

अापरिቝኌJथतीतयाशिकांनीासनानेብኍेळोብኍेळी मिद!ेल्याआदेानुसा जून१९८६पूብኍ एस.एस.सी. डी.एड. हीैशिणकअहBता्ቚा्के!ी नाहीत त्यानंत ( जून१९८६नंत) तेसेብኍेतूनक ीकण्यासपा्ቔठती!.

In view of the above, the Petitioner Bhagwanrao Deshmukh's case will have to be considered in accordance with the abovesaid provision of the GR dated 04.10.1983, if he is eligible for notional pay scale. He can also be held entitled for the pensionary
- 4 - benefits in accordance with the said GR, if eligible. 5.
As is held by this Court in all similar matters, these Petitioners would not be entitled for actual monetary benefits. Their cases can be considered for pensionary benefits. 6.
In view of the above observations/directions, all these Writ Petitions are disposed off.
