This petition is filed for a limited purpose, seeking a direction against Respondent Nos 3 Education Officer, (Primary) to decide proposal regarding approval to appointment of the petitioner as Shikshan Sevak. The proposal was moved on 30.12.2024 and till date, there is no decision on the said proposal. It is to be noted that appointment of the petitioner itself is for the period between 06.11.2024 to 05.11.2027 2.
Although this is the first date of listing of this petition, we are inclined to dispose of the same as Respondent No.3 is represented by a counsel who has instructions to make necessary statement. 3.
Mrs. Thorat, the learned counsel appearing for Respondent No.3 Education Officer (Primary), Zilla Parishad, Nanded, on
952wp8178-25 instructions, makes a statement that the pending proposal pertaining to the petitioner can be decided within eight weeks from today. 4.
It is to be noted that as per Government Resolution dated 04.04.2018, such proposals are to be decided within eight weeks of the Management submitting the proposal to the Education officer. Evidently, the said timeline has not been complied with by Respondent No.3. We have come across many instances where the proposal remains pending without any decision, which is obviously to the detriment of the employees. Therefore, while this petition can be disposed of in the light of the statement made of behalf of Respondent no.3, we expect the Education Officers to strictly adhere to the timeline indicated in the aforementioned Government Resolution dated 04.04.2018. 5.
In view of the above, this petition is disposed of by directing Respondent No.3 to decide the proposal of the petitioner within eight weeks from today. No further time shall be granted. 6.
Pending applications, if any, also stand disposed off. ( Y. G. KHOBRAGADE, J. ) ( MANISH PITALE, J. ) JPChavan
