WITH ABA/935/2022 SUNIL BANDU GAWALI

CORAM :
S. G. MEHARE, J.
DATE :
05-08-2022 PER COURT :- 1.
Heard the learned counsel for the applicants and the learned APP for the respondent/State.
2.
The complainant is a policeman. He has lodged the first information report nine days after the incident. He has alleged against the applicant that he has snatched golden chain from his person and abused him in filthy language and threatened to kill. 3.
The learned counsel for the applicants has vehemently argued that the complainant has lodged the report afterthought. The report was already lodged against the present complainant. Therefore, he has made the false allegations of snatching the
929-ABA-934,5-22.odt golden chain.
3.
The learned APP has fairly pointed out that in the CCTV footage it has not been transpired that the applicant Amol has snatched golden chain from the complainant. However, it seems that there are antecedents to the discredit of the applicants. Therefore, anticipatory bail may not not granted. 4.
It is unfortunate that the police person who is responsible officer also exaggerated the allegations only with a view to see that the applicants behind the bar. The allegations of snatching a golden chain from his person have been falsified by the CCTV camera. Barring the allegations of snatching the golden chain, there are no allegations that may require the police custody of the applicant.
5.
Considering the facts of the case and the material placed before the Court, this Court is of the view that this is a fit case for anticipatory bail. Hence, the following order :- i) The applications are allowed.
ii) The order granting interim protection to the applicants, dated 22.07.2022, is confirmed on the same terms and conditions of the bail.
