CORAM : S.C.DHARMADHIKARI & MANGESH S. PATIL,JJ.

DATE : 19/06/2017 PER COURT :- 1] The petitioner has applied for issuance of a Caste/Tribe certificate in the prescribed form. That application was pending before the competent authority from 21/6/2016. 2] The only reason orally stated for non consideration of this application was that the petitioner's father possessed such a Tribe certificate but scrutiny and verification of the claim based on which this certificate was issued to the father is pending before the scrutiny committee.

3] In these circumstances, the inaction was sought to be justified. 4] When this Petition was placed before us in the morning session and we called upon Mr.P.S.Patil, learned A.G.P. to seek

wp7989-17 -2instructions during the course of the day from the competent authority, the matter was kept back. On second call, Mr.P.S.Patil, learned A.G.P. produced a copy of the Scheduled Tribe Certificate issued by Sub Divisional Officer, Nanded being Certificate No.3305 dated 19/06/2017 in favour of the petitioner. 5] Since this certificate is issued and a copy of that is taken on record and marked "X" for identification, nothing survives in this Writ Petition and it is disposed of. There shall be no order as to costs. (MANGESH S. PATIL,J.) (S.C.DHARMADHIKARI,J.) umg/
