IN THE HIGH COURT OF JUDICATURE AT BOMBAY.

BENCH AT AURANGABAD.

WRIT PETITION NO. 9421 OF 2017 Kohinoor Education Society, Aurangabad, through its Secretary Mazharkhan Anwarkhan ... Petitioner

VERSUS

The State of Maharashtra & Ors.

... Respondents ..........

Mr L. M. Kulkarni, Advocate for the petitioner Mr P. S. Patil, AGP for respondent/State .............

CORAM : S. V. GANGAPURWALA & A. M. DHAVALE, JJ.

DATE : 13TH FEBRUARY, 2018.

ORDER:

1.

The learned advocate for the petitioner submits that, the science stream of the petitioner has been granted 100% grant-in-aid, however, the Computer Science and Electronics subjects are not given grant-in-aid. Computer Science and Electronics subjects are part of science stream/faculty. There was no reason to exclude Computer Science and Electronics subjects, more particularly, when affiliation is granted by the University to these subjects also. According to the learned counsel, the inaction on the part of the respondent is against the policy.

2 Sr18 WP9421.2017 2.

The learned Asst. Government Pleader submits that, there is no policy to give grant-in-aid to Electronics and Computer Science subjects.

3.

The affidavit is filed by the Joint Director, Higher Education, Aurangabad, to the effect that if the affiliation is granted by the concerned University before June-2001 then only the Government has accorded grants vide GR dated 04.04.2012 to the subjects of Computer Science and Electronics and the Government has not provided grants to the subjects of Computer Science and Electronics which are taught after June-2001. In case, in future the Government comes out with the policy to give grants to Computer Science and Electronics subjects, then the petitioner may stake its claim. The grants are always subject to the policy of the Government and cannot be claimed as of right.

4.

With the observations as above, the writ petition disposed of. No costs.
