1] Heard. By the present application, the applicant is seeking his release on bail in connection with Crime No. 141/2015, registered with Chakur Police Station, Dist. Latur, for the offence punishable under Sections 409 of IPC and Under Sections 3 and 7 of the Essential Commodities Act. 2] Heard Shri Rahul Karpe, Advocate for the applicant and Shri V.H. Dighe, learned APP for the respondent.
3] The FIR is lodged by one Shri Vilas Deshmukh, Naib Tahsildar of Chakur. According to the FIR, the applicant who was Store Keeper at Government Godown, Chakur found that the applicant has committed certain irregularities during the period from 23/3/2015 to 30/5/2015, culminating into misappropriation of amount. 4] The applicant was arrested on 15.6.2015. He was in Police Custody Remand till 20.6.2015. During the period of his Police Custody Remand, nothing is discovered at his instance. The applicant is already suspended from service.

6] In view of the fact that the applicant is already suspended and who is in jail since 15.6.2015 and the investigation is already over and the entire record is already seized by the Investigating Officer, in my view, the applicant can be released on bail. This leads me to pass the following order :- (i) Present Criminal Application is hereby allowed. (ii) Applicant Shri Vaijnath Kundlik Munde, be released on bail in connection with Crime No.141 of 2015 registered with Chakur police station, District Latur for the offence punishable u/s. 409 of the Indian Penal Code and U/s. 3 and 7 of the Essential Commodities Act, on he executing a P.R. bond in the sum of Rs. 25,000/- with two solvent sureties in the like amount.
(iii) Bail before the trial court.
(iv) Present applicant shall attend Chakur police station once a week preferably on every Sunday between 3.00 and 5.00 p.m. till the charge sheet is filed. (v) With these observations, present criminal application is disposed of.
