The prayer for transfer is opposed on the ground that the nonApplicant, who is serving as a Police Constable is not in a position to travel and attend the proceeding at Dhule consistently. It is not in dispute that there are two other proceedings, which are going on between the parties at Dhule Court. In view of the Apex Court judgment that convenience of female particularly when she is in custody of a minor child, is to be appreciated, the present application is allowed in terms of prayer clause (a).

It is worth to observe that the Court at Dhule shall make endeavour to fix all the three matters on single date so as to avoid inconvenience to the parties to the proceedings. [ N. W. SAMBRE, J. ] ndm
