Heard learned Advocate appearing for the applicant. 2.

Since the applicant intends to challenge the order of bail passed by learned Judicial Magistrate First Class, the propriety requires that under Section 439(2) of the Code of Criminal Procedure, the applicant should approach the Sessions Court first. Under such circumstance, learned Advocate for the applicant, on instructions, seeks withdrawal of the application with liberty to move the Sessions Court.
