Heard the learned counsel for the applicant. He is seeking bail after the arrest in Non-Bailable Warrant in 2013 on the ground that since 24.01.2020, there was no progress in the case. As against this, the learned APP would submit that the learned Special Judge (MCOCA), Aurangabad has observed in its order dated 18.06.2020 below Exh.155 that the matter is at fag end to record the evidence of the Investigating Officer. 2.
The learned counsel for the applicant further pointed out that thereafter the case has been transferred to Osmanabad and there is no progress. Considering the stage of the trial only one witness i.e. Investigating Officer remained to be examined. In such situation instead of deciding the bail application, it
49-BA.940-21.odt would be appropriate to direct the concerned Court to decide the matter within two (2) months from the date of receipt of this order.

Hence, the present bail application is disposed of. 4.
The learned Special Court (MCOCA), Osmanabad is directed to dispose of Sessions Case No.61 of 2020 within two
(2) months from the date of receipt of this order and there shall be no adjournment from the prosecution as well as accused.
