Learned advocate for the petitioner, on instructions, submits that so far as prayer clause 'B' is concerned, the petitioner would prefer appropriate appeal under Section 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 and so far as prayer clause ' C'

is concerned he would approach the Education Officer with a requisite prayer, who may take appropriate decision.

He, therefore, seeks leave to withdraw the writ petition with liberty to prefer an appeal and approach the Education Officer. 3.

Leave is granted.

The Writ Petition is dismissed as withdrawn with liberty as prayed for. 5.

Time spent in prosecuting this remedy may be considered under Section 14 of the Limitation Act, 1963.
