The applicant has moved this application seeking recall of order dated 07.06.2017 of issuance of Non Bailable Warrant against the appellant.

Pursuant to the non-bailable warrant, the appellant is arrested and produced before the Court for seeking further order. In view of this, the request for recall of order dated 07.06.2017 no more survives.

The appeal is of the year 2003 and matured for final hearing. Therefore, I am not inclined to entertain the application to release him on same bail and surety. Hence, the application is rejected. 4.

Pending appeal, the appellant be committed to prison to undergo remaining sentence as per the judgment and order of conviction passed by the 1st Adhoc Addl. Sessions Judge, Shrirampur in Sessions Case No.4 of 2001.
