Heard the learned counsel for the applicant, the learned A.P.P. for the respondent/State and the learned counsel for the complainant.

The applicant seeks bail in C.R.No.0345 of 2023 registered with Itwara Police Station, District Nanded, for the offences punishable under Sections 302, 384, 386, 307, 294, 143, 146, 147 read with Section 149 of the Indian Penal Code, Sections 4/25 of the Arms Act and Section 135 of the Maharashtra Police Act. 3.
It is a case of extortion by a gang. It has been alleged
against the applicant that he dropped one of the co-accused. While dropping the co-accused, he was carrying gunny bag with weapons i.e. swords. Fortunately, the prosecution has evidence of C.C.T.V. footage. The transcription of C.C.T.V. footage has also been placed on record. However, nothing is found in the C.C.T.V. footage that the applicant and one person reached there with gunny bag. The screenshot of the C.C.T.V. footage placed on record shows that he left the spot of the incident after three minutes. In such a situation, recovery at his instance at the spot would fall for consideration on merit. The applicant is a college going boy of 23 years old having no bad past. The investigation has been completed. Further detention of the applicant appears not essential. Hence, he deserves bail on certain conditions.
ORDER
i) Bail Application is allowed.
ii) Applicant Sangramsingh Sanjaysingh Pardeshi be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He shall report his presence in the town after every fortnight on Thursday to the concerned Police Station, physically, between 10.00 a.m. and 1.00 p.m. till the trial is concluded.
(b) He shall not contact the co-accused.
(c) He shall not tamper with the prosecution witnesses. (d) He shall surrender his pass-port, if any.
(e) He shall furnish proof of his residence and cell number to the police, with an undertaking that he would not change it untill the trial is concluded.
(f) He shall attend the trial on each and every effective date.
(g) He should not leave the town without the leave of the trial Court.
iii) Criminal Application No.2667 of 2024 stands disposed of. ( S. G. MEHARE ) JUDGE rrd
