I have heard the learned counsel for the applicant for some time.

In terms of the order dated 28.10.2020 (Coram : M.G. Sewlikar, J.), the learned APP has called the report from Jailor on the point of diet and the protein content in the diet of the applicant and also on the point whether the applicant is HIV positive or not. It is not disputed that the applicant is HIV Positive, however, as per the report received from the in-charge superintendent, District prison, Latur, high protein diet is regularly given to the applicant which includes milk, boiled eggs, etc. and also there is regular CD-4 aaa/-

BA 1256.2020.odt examination through jail. It is reported that his health condition is stable.

Learned counsel for the applicant, on instructions, seeks leave to withdraw this bail application, however, the learned counsel submits that said high protein diet shall be given to the applicant continuously with the periodical check up alongwith CD-4 examination and ART treatment from the specialized hospitals. 4.

Leave granted.

Bail application is disposed off as withdrawn. The Jail authorities are hereby directed to give continuously protein diet to the applicant without fail and, also refer him to ART Center for his treatment regularly. The applicant is at liberty to fle an application for expeditious hearing of the case before the trial court and upon fling such an application, the trial court may consider the same.
