Heard the learned counsel for the applicant and learned APP for the respondent-State.

The applicant seeks bail in Crime No.102 of 2024, registered with Bhoom Police Station, District Osmanabad, for the offences punishable under Sections 394, 364, 342 and 506 read with Section 34 of the IPC.

There is inordinate delay in lodging the FIR. The allegations were that the applicant abducted the first informant and confined him in the house of applicant and beat him with iron rod. It has also been alleged that the applicant and coaccused stolen the Ertiga car. However, it has been recovered. Except these allegations, there is nothing against the applicant
940-BA.1117-24.odt why he abducted the first informant and confined him. Nothing is to be recovered from the applicant. The antecedents to the discredit of the applicant as pointed out by the learned APP appears to have no relevance with this case. This is an independent case. Therefore, he deserves bail. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant SIDDHESH DATTATRAYA SHINDE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the condition to attend the Police Station as and when called on written notice by the Investigating Officer till filing charge sheet.
