Heard Mr S.S. Dargad, learned counsel holding for Mr S.G. Chapalgaonkar, learned counsel for applicant. 2.
Mr H.A. Patankar, learned counsel for respondent No.1 remained absent when the matter is called out online. 3.
Mr Dargad, learned counsel for the appellant submits that he has already served the copy of pursis regarding withdrawal of appeal on the other side counsel. He submits that the matter has been amicably settled between the parties before the Lok Adalat. As such, appellant may be permitted to withdraw the appeal. He further submits that the Registrar (Judicial) of this Court may be directed to transfer the amount deposited in this Court to the Motor Accident Claims Tribunal, Dhule for making payment thereof to the claimant.

Having regard to the submissions of Mr Dargad, learned counsel for the appellant, it is necessary to allow the appellant to withdraw the appeal since it is amicably settled between the parties.
ORDER
(i) The appeal stands disposed of as withdrawn.
(ii) No order as to costs.
(iii) The amount deposited in this Court by the appellant/M/s Shriram Insurance Co. Ltd. be transferred to the Motor Accident Claims Tribunal, Dhule in relation to MACP No. 164/2010.
(iv) The Court fee refund certificate be issued in the name of the appellant as per rules (v) In view of disposal of appeal, Civil Application also stands disposed of.
