Learned counsel for the applicants, on instructions, seeks permission to withdraw the Criminal Application with liberty to file the application for discharge. He further submits that, charge is not yet framed. In the light of above, the criminal application is dismissed as withdrawn with liberty as prayed for. However, we make it clear that, in case charge is already framed, there is no question of filing application for discharge. Liberty available to the applicants for filing application for discharge is only up to 3rd August 2015.
