The petitioner has set out prayers as against respondent No.3Beed District Central Co-operative Bank, which is registered under the Maharashtra Co-operative Societies Act.

As regards the issue as to whether respondent Nos.3 and 4 would be covered by Article 12 of the Constitution of India, the law laid down in Shamrao Vithal Co-Operative Bank Ltd. and another Vs. Padubidri Pattabhiram Bhat and another, 1993 (1) Mh.L.J. 1, and the Judgment of the learned Full Bench of this Court in Vassudev Madkaikar Vs. State of Goa, 2021 (6) ABR 718, renders this

WP 7834-2022 petition untenable.

The learned Advocate for the petitioner submits, that the petitioner desires to withdraw this petition and avail of a remedy as may be permissible under the Maharashtra Co-operative Societies Act.

In view of the above, this petition is disposed off with liberty as is prayed for.
