Heard learned counsel appearing for the applicants Though respondent nos. 1 and 2 are served, none present for them.

This is an application filed by the applicants for condonation of delay of 123 days caused in filing First Appeal.

Learned counsel submits that appellant no.1 widow of deceased was representing the proceedings before the Tribunal. The appellant is

ca6358,16 illiterate and there is nobody to help her in such legal matters.

The applicants were informed about the mistake in the judgment about the rate of interest. Therefore, the applicants collected documents and handed over the same to their advocate at Jalgaon and in that process some delay has been caused.

Looking to the grounds mentioned in the application, I am satisfied that the delay has been properly explained, and therefore, it is liable to be condoned. Accordingly, the same is condoned.

Civil Application is disposed of.
