1] Heard learned counsel for the applicant and the learned APP for the respondent-State.

2] The applicant is apprehending arrest in connection with Crime No.407/2024, registered at Kotwali Police Station, Taluka and District Ahmednagar, for the offences punishable under sections 406, 420, 506 r/w. 34 of the Indian Penal Code.

3] The case against the applicant is that the accused has taken money from the informant for the purpose of investment in the Mutual Fund [M.F.] and money is not at all invested in the M.F.

1101.24ABA 4] The learned counsel for the applicant submits that the applicant has taken money from the complainant and the same was invested in the M.F. and he has produced account extract to that effect.

5] Perusal of the account extract, prima facie, would indicate that the money is paid to the applicant by the complainant, however, further transfer of funds by the applicant does not show that the money was transferred towards investment account of complainant. The money is transferred to some private accounts by the applicant and not towards investments. In view of the same, custodial interrogation of the applicant is necessary in the matter. Hence, the present application is dismissed.

6] The prayer for continuation of interim protection stands rejected.
