The learned counsel for the applicant would submit that the other co-accused have been released in various crimes. The applicant was the Director of the co-operative credit society. The audit was done. The auditor has candidly opined that there was no misappropriation of the funds of the society, however, there was mismanagement. Considering the audit report and the fact that many similarly situated Directors have been released on anticipatory bail, the present applicant may be released on anticipatory bail.

The learned APP has verified the facts and satisfied that similarly situated Directors have been released on anticipatory bail. Therefore, the application deserves to be allowed. Hence, the following order :- i) The application is allowed.

ii) The interim protection granted to the applicant by the order dated 22.07.2022 is confirmed on the same terms and conditions.
