Heard the learned counsel for the applicant and learned APP for the respondent-State.

The applicant seeks bail in Crime No.208 of 2024, registered with Pundliknagar Police Station, District Aurangabad, for the offences punishable under Sections 376(2)(n), 313, 323 of the IPC.

Examined the facts of the case. From the papers produced before the Court, it reveals that the victim was 32 and the applicant was 42 years old. It is a clear case of consensual sexual relationship for a long time. Nothing is to be recovered from the applicant. It seems that there was a discord between them. In view of the facts of the case, nothing

943-BA.1128-24.odt is to be recovered from the applicant. No purpose would be served by keeping the applicant behind bar. However, certain conditions may be imposed while enlarging him on bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant PREM @ PRAMOD PRABHAKAR RUPWATE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) He shall not tamper with the prosecution witnesses.

(b) He shall not contact the victim in any mode or manner till the trial is concluded.

(c) He shall not enter the place where the victim is residing till the trial is concluded.

(d) He shall attend the attend the Police Station as and when called on written notice by the Investigating Officer till filing charge sheet. (S. G. MEHARE, J.) ...
