MANISH PITALE AND Y. G. KHOBRAGADE, JJ.
DATE : 29.07.2025 PER COURT :
1.
Having heard learned counsel for the petitioner and in light of the submissions made by Mr. Kadethankar, learned counsel appearing of respondent No. 2 - the State Election Commission, we are of the firm opinion that the present petition is filed without any cause of action and it is premature.
2.
The grievance of the petitioner appears to be that he may be disqualified from contesting the elections to Municipal Council, Ausa. 3.
As the election program is yet to be declared, it is evident that the petition is filed merely on the basis of apprehension, and there Jhs/ 1/2
974 WP NO. 9326 OF 2025 exists no specific cause of action that entitles the petitioner to knock the door of the Writ Court.
4.
In view of the above, the writ petition is dismissed. 5.
Pending applications, if any, also stand disposed of. (Y. G. KHOBRAGADE, J.) (MANISH PITALE, J.) Jhs/ 2/2
