Heard Shri Dhage, learned Counsel for the applicants. 2.

Having regard to the grounds of objections raised in exception of the impugned judgment and award and considering the averments in the application for withdrawal of the amount, I deem it appropriate to pass the following order:

ORDER

1.

The application is partly allowed.

2.

Applicant No.1 Latabai widow of Charansing Naymane, applicant no.4 Purbabai Dhansing Naymane, and applicant no.5 Dhansing Daulat Naymane are permitted to withdraw 50 per cent of the deposited amount in terms of the share allotted to them by the Tribunal in the impugned award. Each of the aforesaid applicant be issued a separate cheque of his or her share in his or her name. Balance 50 per cent of the amount of their share as agp/-

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD (2) CA NO.10905 of 2016 well as the other amount deposited by the Insurance Company, which belongs to the shares of minors, be invested in Fixed Deposit Receipt in any nationalized Bank initially for a period of two years and if so required for further period till disposal of the appeal. 4.

Civil Application for withdrawal of amount stands disposed of in above terms.
