Mr.Deokate, learned counsel for the petitioner submits that the father of the petitioner was working with the Respondent No.4. While in service, he died in the year 2010. The petitioner immediately filed an application for appointment on compassionate ground, however, the said application is not considered. According to the learned counsel, as per clause 15 of the Annexure to the Circular dated 17.3.2006, the petitioner is entitled to be appointed on compassionate ground.

Mr.Bagal, learned counsel for the Respondent No.4 submits

that as per clause 11 of the same Annexure, the petitioner is not entitled for compassionate appointment as the father of the petitioner was working on daily wages prior to 1993. The father of the petitioner was absorbed as a special case on supernumerary post.

As the father of the petitioner was working on supernumerary post, the said post would stand abolished on the death of the father of the petitioner, as such the grievance of the petitioner seeking appointment on compassionate ground certainly can not be considered.
