A specific averment of the Petitioner in the complaint dated 05/03/2018, addressed to the Municipal Corporation, Jalgaon, is that, the encroachers have constructed their Bungalows in the open plot and they are using the land of the Petitioner for enjoying the said Bungalows.

The learned Advocate for the Petitioner submits that the Petitioner would avail of a remedy of filing a Civil Suit, for injuncting the encroachers from using his land.
