First information report is filed by the present applicant and other accused persons in connection with Crime No. 40 of 2017, registered at Dhule City police station, District Dhule for the offence punishable under Section 307 of the Indian Penal Code.

Informant Vishnu Wadile lodged complaint alleging that on 19.2.2017 present applicant and others assaulted him by means of iron rod, wooden
sticks and fist and kick blows, due to which he sustained injuries.

During the course of investigation, the other accused persons were arrested and released on regular bail. While releasing them on bail, learned Additional Sessions Judge in para 6 of the order has specifically observed that original complainant filed an affidavit giving no objection to release the other accused persons as the matter is amicably settled.

Learned counsel appearing for the applicant submits that the matter is amicably settled between the parties and they are going to file Criminal Writ Petition for quashment of the pending proceedings.

In view of above, custodial interrogation of the applicant is not necessary.

Hence, the following order.
(i) Criminal Application is allowed.
(ii) In the event of arrest, applicant be released on bail in connection with Crime No. 40 of 2017, registered at Dhule City police station,
District Dhule, on furnishing P.R. bond of Rs. 10,000/- with one surety in the like amount.

Criminal Application is disposed of.
