Heard. This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicants have been arrested in connection with Crime No.0085/2022, registered at Rajur Police Station, District Ahmednagar for the offences punishable under Sections 302 and 341 read with Section 34 of the Indian Penal Code and Sections 4/25 of the Arms Act.

A copy of the charge sheet has been placed on record. It is evident therefrom that the present applicants are sought to be prosecuted for the offences punishable under

Bail Appln. No.1057/2022 :: 2 ::

Sections 323, 504, 506 read with Section 34 of the Indian Penal Code and Sections 4/25 of the Arms Act. The learned A.P.P. does not dispute this position. The applicants have been behind the bars since 8/5/2022. Considering the nature of offence alleged to have been committed by the present applicants, I am inclined to grant bail to the applicants. Hence the order :-

O R D E R

(i) The Bail Application is allowed.

(ii) The applicants be released on bail in connection with Crime No.0085/2022, registered at Rajur Police Station, District Ahmednagar for the offence punishable under Sections 302 and 341 read with Section 34 of the Indian Penal Code and Sections 4/25 of the Arms Act on their executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) each with one surety in the like amount.

(iii) The applicants shall not tamper with the prosecution evidence.
