We have heard the learned Advocate for the applicant, the learned APP on behalf of respondent Nos. 1 and 3 and the learned Advocate on behalf of respondent No.2, original complainant. 2.

Based on the information received by the Registry of this Court, the Uroflowmetery test can be conducted at United Cigma Hospital, Aurangabad.

It is informed that the Sessions Case No.411/2016 is posted today for the learned Prosecutor to advance his oral submissions. The time limit granted by this Court while disposing off Criminal Appeal khs/Oct.2020/1877

- 2 - No.336/2020 has already expired.

In view of the above, the learned Advocate for the applicant submits that if the proceedings before the Trial Court are decided expeditiously, he would be at liberty to avail of medical facilities in the event he is acquitted. In the event an adverse order is passed, he could renew his request for a Uroflowmetery test to be conducted on the applicant at United Cigma Hospital at Aurangabad. 5.

In view of the above, this application is disposed off with a direction to the learned Prosecutor before the Trial Court to conclude his submissions, to be commenced today, latest by 27/10/2020, in view of the statement made on instructions by the Applicant that the defence has already concluded its oral submissions. The learned Trial Court shall thereafter deliver it's judgment in Sessions Case No.411/2016 as expeditiously as possible and in any case on or before 10/11/2020.

The Registry of this Court shall intimate the learned Sessions Court of this order. So also, the learned APP would appraise the learned Prosecutor accordingly.
