This is an application for granting bail under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, in connection with Crime No.270 of 2024 registered at Beed Police Station, district Beed, for the offences punishable under Sections 103 and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

The informant, Sayyed Jafar S/o Sayyed Akhter, averred in the report that his brother, Majhar, was having illicit relationship with a woman and due to that relationship, unknown persons murdered his brother on 14.11.2024. Based on this, a report was lodged alleging that Anita Admane and Limbaji Kanade may have committed the said offence.

The learned advocate for the applicant submitted that there is no incriminating evidence against the applicant. The applicant has roots in the society and he will not flee away from the trial. He has no criminal antecedents. The trial will take a long period. He submitted that the other co-accused have already been released on bail. It is lastly prayed to grant bail to the applicant on the ground of parity. 5.

The learned APP for the State strongly opposed the application and submitted that a wooden stick was recovered at the instance of the applicant, indicating his involvement in the crime. The learned APP pointed out the post mortem report and statements of witnesses in support of his submissions. It is lastly prayed to reject the application. 6.

Perused the charge-sheet, particularly the report, statements of witnesses and the post mortem report. Although a wooden stick was seized at the instance of the applicant, it does not bear any blood stains. The applicant has roots in the society. Considering that the other co-accused have already been released on bail, the present applicant is also entitled to be released on bail on the ground of parity. Hence, the following order: ::ORDER::

The application is allowed.

The applicant, in connection with Crime No.270 of 2024 registered at Beed Police Station, district Beed, for the offences punishable
