The applicant, a Teacher in Zilla Parishad, is seeking pre-arrest bail, in connection with C.R. No.208 of 2016, registered with MIDC (CIDCO) Police Station, Aurangabad for offences punishable under sections 306, 498-A, 323, 504, 506 read with section 34 of the Indian Penal Code and under sections 3 and 4 of the Dowry Prohibition Act. 2.
It is the case of the prosecution that the son of the applicant Nikhil was married to the daughter of complainant Anjali. Anjali committed suicide on 23rd May, 2016.

As the event of suicide was within a period of one year of the date of marriage, the offence came to be registered.

Learned Counsel appearing on behalf of the applicant would submit that apart from the fact that the applicant was residing separate from her son Nikhil and deceased Anjali, she is a public servant, being Teacher in Zilla Parishad school and will be very much available for investigation. 5.
Learned Addl. Public Prosecutor opposed the application on the ground that the investigation papers do not depict that the applicant was residing separate from her son Nikhil and deceased Anjali. 6.
Apart from above, there is no other material to connect the applicant with the crime in question. In view thereof, application needs to be allowed. I, therefore, pass following order :- In the event of arrest of the applicant, in connection with C.R. No. 208 of 2016, registered with MIDC (CIDCO) Police Station, Aurangabad for offences punishable under sections 306, 498-A, 323, 504, 506 read with section 34 of the Indian Penal Code and under sections 3 and 4 of the Dowry Prohibition Act, she be released on bail, on furnishing P.R. Bond of Rs.15,000/- with one surety in the like amount. The applicant shall attend the concerned police station initially on 6th and 7th August, 2016, between 10.00 a.m. and 12 noon and thereafter as and when called by the Investigating Officer.
