DATE : 09/08/2017 PER COURT :- The order of the Tribunal, directing the present petitioner to pay Rs.900/- p.m. to the present respondent is assailed. 2] Mr.Kale, learned AGP submits that the respondent is working as a Sweeper on clock hour basis. Time to time, the amount is increased by the Government and at the relevant time, as the Sweepers were paid Rs.600/- p.m., however, the Tribunal directed to pay Rs.900/- p.m., without any basis. The Tribunal only relied on the order passed in Original Application No.215/1995 with other Original Applications and the order is passed without any basis, the same deserves to be set aside.

-23] The learned counsel for the respondent supports the order and submits that in fact the Tribunal has not granted the entire relief to the respondent and ought to have granted half of the salary payable to Peon/Sweeper.

4] We have considered the submissions. The Tribunal has relied on the order passed in Original Application No.215/1995 and other bunch of petitions decided on 21/12/2000. The order in similar Original Applications were challenged before this Court in Writ Petition No.3340/2001 with connected Writ Petitions, the same has been decided by this Court on 24/08/2010 and the Writ Petitions filed by the State are dismissed, thereby confirming the order of the Tribunal.

5] For the reasons stated in the judgment dated 24/08/2010 in Writ Petition No.3340/2001 with connected Writ Petitions, the present Writ Petition also stands dismissed. Rule discharged. No costs. (MANGESH S. PATIL,J.) (S.V.GANGAPURWALA,J.) umg/
