The learned Counsel for the petitioner insists for granting interim relief so as to enable the petitioner to appear for the I Year M.B.A. TECH Course second semester scheduled to be held on 30th June, 2016. He submits that the students, whose attendance is comparatively less than the petitioner, are allowed to appear for the said examination.

6833.16wp We do not find any justifiable reason to consider the prayer of the petitioner to allow him to appear for the examination scheduled to be held on 30th June, 2016.

The learned Counsel for the respondent No.1 has tendered across the Bar copy of the order passed by the Division Bench at Principal Seat in Writ Petition (L) No.908 of 2016 (Nikita Garg & Ors. Vs Vile Parle Kelwani Mandal and Ors.) wherein, the same issue was considered by the Division Bench and the petition came to be dismissed.

In that view of the matter, for the same reasons which are assigned by the Division Bench in the aforesaid order, the petition stands rejected.
