Mrs. Kulkarni, learned Counsel appearing on behalf of the petitioner points out an order dated 01.02.2016 passed by this Court (Coram: V.K. Jadhav, J.) in Writ Petition No. 11928/2015 in the matter of Mohan Sawairam Jadhav Vs. The State of Maharashtra and Others, to contend that the challenge to a similar impugned order was not entertained by this Court on the ground that an alternate remedy before the State Government is available for the petitioner.

Mrs. Kulkarni therefore submits on instructions that the petitioner desires to avail an alternate remedy and the time spent in this Court from 31.07.2012 till the disposal of this petition today may be considered for condonation of delay.

The learned Counsels for respondents have no objection. 4.

In the light of the statement made on instructions, and the order dated 01.02.2016 cited as above, this petition is disposed off as being withdrawn with liberty to avail an alternate remedy. The time spent in prosecuting this petition shall be a good ground for condonation of delay, if any.
