Vishwasrao Bhaskarrao Patil v. The State Of Maharashtra And Others
- 1 -
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.7633 OF 2020 VISHWASRAO BHASKARRAO PATIL
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS Mr.Y.M.Patil, Advocate for the petitioner.
Smt.V.N.Patil-Jadhav, AGP for respondent Nos. 1 to 4. Mr.V.S.Bedre, Advocate for respondent Nos. 5 and 6. ( CORAM : RAVINDRA V. GHUGE & S.G. MEHARE, JJ) DATE : NOVEMBER 23, 2021 PER COURT :
1.
We have heard the learned Advocates for the respective sides, have perused the petition paper book with their assistance and have also gone through the order dated 17/07/2017 passed by this Court in WP No.9408/2012 filed by the petitioner. The issue as to whether the petitioner was absent in between 2011 and 2017 or whether he was not allowed to resume duties, is pending before respondent No.3, as per the instructions of the learned Advocate for the petitioners. 2.
The affidavit in reply filed by respondent No.6 and the khs/Nov. 2021/7633
- 2 - accompanying documents, would indicate that the provident fund accumulations have already been paid to the petitioner and though his application for voluntary retirement has been accepted, the proposal for a decision on the purported break in service from 2011 to 2017 is pending with respondent No.3. Based on the decision to be delivered on the same, respondent No.6 would then forward the proposal for retiral benefits.
3.
In the light of the above and considering the prayers put forth by the petitioner, this petition has been worked out and therefore stands disposed off. We expect respondent No.3 to take a decision as expeditiously as possible and in any case, on or before 07/01/2022. ( S.G. MEHARE, J. ) ( RAVINDRA V. GHUGE, J. ) khs/Nov. 2021/7633
