DATE :

13th August, 2025 P.C. :- 1.

Heard the learned counsel for the Petitioners and the learned GP for the Respondent/ State Authorities.

2.

The learned counsel for the Petitioner relies upon the judgment of this Court in the case of Madhukar Bhagwanrao Sadgir V/s. State of Maharashtra & Ors. (Judgment and order dated 31.10.2018 passed in Writ Petition No.5867/2015), as also subsequent order dated 07.03.2025 passed in Writ Petition No.9451/2023) (Jalan Punya Valvi & Ors. V/s. The State of Maharashtra & Ors.).

( 2 ) 3.

It is submitted that the instant petition can be disposed of in the light of the aforesaid judgment and order. 4.

The Petitioners herein are also seeking regularization and permanency in teaching and non-teaching posts in Ashram Schools run by the Respondent/State Government. When identical issues came up for consideration before this Court in the aforementioned judgment and orders, the Respondent/State came forward to make a statement that a verification exercise concerning the Petitioners therein would be carried out within a stipulated period of time to consider their grievance regarding regularization and permanency.

5.

The learned GP on instructions submits that such an exercise can be carried out in respect of the Petitioners also within a stipulated period of time.

6.

In view of the above, the instant petition is disposed of in terms of the directions issued earlier by this Court in the case of Madhukar Bhagwanrao Sadgir (supra) and Jalan Punya Valvi & Ors. (supra). Accordingly, we direct the Respondents to carry out verification exercise in respect of the Petitioners in this petition regarding their eligibility for grant of regularization and permanency, considering the number of years of

( 3 ) service that they have put in. Such exercise shall be completed within a period of 180 days from today.

7.

Till such time that the exercise is completed the order of status quo dated 26.06.2023 granted by this Court in the instant petition shall continue to operate.

8.

The Writ Petition is disposed of in above terms. Pending applications, if any, also stand disposed of. 9.

Without prejudice to the directions given herein-above and the fate of the Petitioners herein in terms of the exercise directed to be conducted by the Respondents, we are of the opinion that the Respondents should undertake the process of selection of qualified candidates on available vacancies through the regular selection process so that the aforesaid issue of regularization of temporarily appointed candidates does not recur in the future. Such steps shall also be taken expeditiously. [Y.G. KHOBRAGADE, J.] [MANISH PITALE, J.] mub
