Learned Advocate for the petitioner submits that, following prayers are made in the Writ Petition : (A) By issue of writ of mandamus or any other writ, order or direction in the like nature, the Respondent State Govt. be directed to grant permission ion favour of the HBP Narayandeo Shikshan Prasarak Mandal, Takli Antur, Tq.

Kannad, Dist. Aurangabad to open new senior college of Arts at Pishor, Tq. Kannad, Dist. Aurangabad from the academic year 2012-2013.

(B) By issue of writ of certiorari or any other writ, order or directions of like nature the impugned order dated 15/6/2012 issued by the respondent No.1 (Exh."E") may kindly be quashed and set aside to the extent of granting permission in favour of respondent No.4 Sanstha to open senior college of Arts, Commerce and Science at Pishor, Tq. Kannad, Dist. Aurangabad.

(C) Pending hearing and final disposal of the Writ Petition, the respondent No.2 and 3 may kindly be restrained from considering grant of affiliation and recognition of institution run by the respondent No.4 Sanstha at Pishor. 2.

Learned Advocate for the petitioner submits that, since the prayers were for permission in favour of the petitioner to open new Senior College in the academic year 2012-2013, which is more than a decade, seeks leave to withdraw the Writ Petition with liberty to make fresh application to the competent authority for next academic session.

Learned A.G.P. appearing for respondent No.1 - State and learned Advocate appearing for respondent No.2 are present.

In view of the above submissions made by learned

Advocate for the petitioner, the Writ Petition stands disposed of as withdrawn. The petitioner would be at liberty to make appropriate application before the appropriate authority for permission to open new Senior College, if available under the law.
