Considering the request put-forth, we are not issuing notice in this matter.

The Petitioner submits that his father's land was utilized for setting up the Vasantrao Naik Marathwada Agriculture University at Parbhani. His father has a Project Affected Persons certificate, dated 09.07.2008. The Petitioner had filled in a form with the University in the light of the advertisement dated 26.08.2009 seeking appointment as a Majdoor. Last date for making the application, was 05.10.2009. It is the contention of the Petitioner that said application is still pending. There is no pleading in the

( 2 ) 923 wp 9201.24 memo of the Petition as to whether there are any posts available, whether any further advertisement was issued etc.

The learned AGP submits that the Full Bench of this Court delivered a judgment in Rajendra Pandurang Pagare V/s. The State of Maharashtra & Ors.; (2009) 4 Mh.L.J. 961, vide which even a Project Affected Person has to compete along with other similarly situated persons and weightage would be given only for the category of PAP. 4.

In view of the above, this Writ Petition is disposed off. We expect Respondent No.2 to deal with the application of the Petitioner (undated), purportedly filed in response to the advertisement dated 26.08.2009, within a period of 60 days. Whatever is the response of the University, the same may be communicated to the Petitioner. We make it clear that we have not expressed any opinion as regards the claim application of the Petitioner.
