The learned Advocate for the petitioner submits that, the petitioner has already approached the Education Officer challenging the seniority list submitted by the Management, the same is not yet decided. The petitioner claims himself to be senior. 2.

The learned AGP accepts notice for respondent nos.1 and 2. 3.

In the seniority list submitted by the Management to the Education Officer, the petitioner is not shown senior. He has raised objection under Rule 12 of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981. In that event, it is for the Education Officer to take decision upon the seniority. Gajanan

The Education Officer shall decide the objection of the petitioner on its own merits, after hearing all the persons concerned that may be affected. The decision shall be taken preferably within four months.
