2025:BHC-AUG:17041 20-wp-7784-2025.odt (1)
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 7784 OF 2025 Khatib Mohammad Siddiqui S/o Mohammad Yusuf
VERSUS
The State Of Maharashtra Through Ld Collector And Others ...
Advocate for the Petitioner : Mr. Fulfagar Anuj Ajay AGP for Respondent/State : Mr. S.P. Joshi ...
CORAM : S. G. CHAPALGAONKAR, J.
DATED : JULY 03, 2025 PER COURT :- 1.
The petitioner impugns order dated 13.05.2025 passed by learned Collector, Chhatrapati Sambhajinagar in Petition No.225/Appeal/MLRC/CR-42.
2.
Learned advocate appearing for petitioner submits that petitioner has filed appeal before Additional Collector at Chhatrapati Sambhajinagar against order dated 04.02.2025 passed by SubDivisional Officer, Kannad. Initially, the learned Additional Collector was pleased to grant stay to order of Sub-Divisional Officer vide his order dated 21.03.2025. He points out that it was a final order directing parties to maintain status quo. However, by subsequent order dated 13.05.2025 which is impugned in this petition, the order granting status quo is vacated. Eventually, the change in mutation record is caused which has created multiplicity of litigation. 3.
Learned advocate appearing for petitioner further submits that now, the appeal is posted on 28.07.2025. He apprehends
20-wp-7784-2025.odt (2) that in view of subsequent change in mutation record, the proceeding in appeal is likely to be dragged by respondents. In that view of matter, instead of going into controversy raised, the purpose would be served if the appeal pending before Additional Collector is expeditiously decided.
4.
In that view of matter, writ petition is disposed of with direction to learned Collector to decide pending appeal within a period of eight weeks from the date of this order. 5.
All contentions are kept open.
