1] Heard learned counsel for the applicant and the learned APP for the respondent-State.
2] The applicant is apprehending arrest in connection with Crime No. 112/2024, registered at Nizampur Police Station, Taluka Sakri, District Dhule, for the offences punishable under sections 307, 143, 147, 148, 149, 323, 504, 506 of the Indian Penal Code.
3] The learned counsel for the applicant submits that this Court, by order dated 2nd July, 2024 in Anticipatory Bail Application No.853 of 2024, in the same offence, has granted bail in favour of the co-accused. The learned counsel further submits that this Court, by order dated
08.07.2024, has granted interim protection in favour of the applicants and the applicant has cooperated with the investigation and has not influenced any other witnesses. The learned counsel further submits that in view of the same the present applicant be released on anticipatory bail. 4] The allegations made against the present applicant are that the applicant injured the victim with sticks blows on the head, hands, legs and back. The investigation in the matter is near completed qua the applicant. The nature of corresponding injury caused by the applicant is simple in nature.
5] The learned APP points out that recovery is also at the instance of the applicant.
6] Since no further investigation is required to be done at the hands of the present applicant, the interim protection granted by order dated 08.07.2024, stands confirmed, on the following conditions :
i] The applicant shall attend the police station as and when called by the Investigating Officer. ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.
iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.
7] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled.
8] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
9] The application stands disposed of.
