The learned counsel for Petitioners, on instructions, submits that the matter has been amicably settled between the parties and accordingly the Respondent / wife has withdrawn the case bearing R.C.C. No.1895 of 2013, pending before the 7th Judicial Magistrate First Class, Aurangabad and by order dated 21st December, 2016, the said Court has disposed of the case in terms of the settlement by the parties before the Mediator. Similarly, Criminal Application No.466 of 2014 filed by the wife against the present Petitioner under Section 12 of the Domestic Violence Act also disposed by 7th Judicial Magistrate First Class, Aurangabad by order dated 21st December, 2016 in terms of the settlement arrived between the parties before the Mediator.

916 wp.876.15.odt Further it also agreed between the parties that the proceedings pending before the Family Court will be withdrawn on 28th December, 2016.

The learned counsel submits that in view of the above, the cause for filing the present criminal writ petition has been rendered infructuous. The criminal writ petition is accordingly disposed of as infructuous.
