Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant is seeking bail in FIR No.329 of 2023 registered with M.I.D.C. Police Station, Taluka and District Jalgaon, for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 3/25 and 4/25 of the Arms Act. 3.

On suspicion, the applicants were apprehended and socalled weapons allegedly used in an attempt to commit dacoity have been seized. Nothing is to be recovered from the applicant. His antecedents would not come in his way to seek bail. Considering the nature of offence, his particular role and the weapon seized from him, he deserves bail. Hence, the order:-

ii) Applicant Yash Devidas Shankpal be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in C.R.No.329 of 2023 registered with M.I.D.C. Police Station, Taluka and District Jalgaon, for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 3/25 and 4/25 of the Arms Act, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall attend the police station as and when called by the Investigating Officer on written notice, till filing the chargesheet.
