wp6956-2016
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 6956 OF 2016 (Bhagwan Bhainaji Bhole Vs. The State of Maharashtra and others) ---- Mr. P.G. Rodge, Advocate for the Petitioner Mr. P.N. Kutti, A.G.P. for respondent Nos. 1 and 2 ---- CORAM :
S.S. SHINDE AND SANGITRAO S. PATIL, JJ.
DATE : 4th JULY, 2016 PER COURT :
1.
Heard learned counsel for the petitioner.
2.
The learned counsel for the petitioner submits that the petitioner is the only teacher to teach English subject. He further submits that the impugned transfer order is issued with malafide intention inasmuch as the petitioner opposed shifting of the school from Loha to Nanded. He submits that such transfer is contrary to the provisions of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981 and will cause inconvenience to the petitioner.
3.
We have heard the learned counsel for the
wp6956-2016 petitioner and perused the impugned order dated 31.05.2016, by which the petitioner has been transferred from the school at village Betsangvi Taluka Loha to the school at village Gonar, Taluka Kandhar, on administrative ground. We do not see any reason to accept the submission of the learned counsel for the petitioner that the impugned transfer is for the malafide reason or for extraneous consideration. In that view of the matter, the writ petition stands rejected.
