The salary of the petitioner is stopped. According to the petitioner it is stopped only on the ground that validation proceeding is pending.

The learned Assistant Government Pleader for respondent Nos. 1 to 5 on instructions submits that, the validation proceeding in respect of tribe claim of the petitioner is pending with the Committee and same is at the stage of vigilance. 3.

Unless vigilance is conducted the petitioner has no role to play in deciding validation proceedings.

The Committee shall decide the validation proceeding in respect of the tribe claim of the petitioner expeditiously and

2 wp 7264.20 preferably within a period of six (06) months from the date of appearance of the petitioner. The petitioner shall appear before the Committee on 02nd December, 2020 and cooperate in expeditious disposal of the proceeding. The respondents shall not withhold the salary of the petitioner only on the ground that validity certificate is not submitted. The respondent/employer may take further course of action depending upon the judgment that would be delivered by the Committee in validation proceeding.

In the light of the above, the writ petition is disposed of. No costs.
