The applicant no.1 is a senior citizen and the decree of mesne profit has been passed in his favour. The appeal filed against the same decree before the District Court is also dismissed. However, the second appeal is admitted and pending for consideration.

It is urged that the appeal be placed for final hearing considering the age of applicant no.1/ respondent no.2 in appeal. 3.

In that view of the matter, civil application is allowed in terms of prayer clause - '

and the same is disposed of.

Post the matter for final hearing in the week commencing from 16th October, 2023.
